By accessing or using SafetyHub Pro, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service.

Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use SafetyHub Pro. By using our services, you represent that you meet these eligibility requirements.

Modifications to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of significant changes by email or through a notice on our platform. Your continued use of SafetyHub Pro after such modifications constitutes your acceptance of the updated terms.

Platform Overview

SafetyHub Pro is a fleet management and DOT compliance platform designed to help transportation companies manage their safety operations, track inspections, manage drivers and vehicles, and maintain compliance with federal and state regulations.

Service Features

Our platform includes features such as fleet management, driver management, inspection tracking, violation management, DataQ challenge preparation, safety analytics, compliance monitoring, and document storage. Features may vary based on your subscription plan.

Service Availability

While we strive to maintain 99.9% uptime, we do not guarantee uninterrupted access to our services. We may temporarily suspend access for maintenance, updates, or due to circumstances beyond our control.

Account Registration

To use SafetyHub Pro, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Account Security

You must immediately notify us of any unauthorized use of your account or any other security breach. We are not liable for any loss or damage arising from your failure to comply with these security obligations.

Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to violation of these Terms of Service, non-payment, or fraudulent activity.

Subscription Plans

SafetyHub Pro offers various subscription plans with different features and pricing. Details of each plan are available on our pricing page. You agree to pay all fees associated with your selected plan.

Billing and Payment

Subscription fees are billed in advance on a monthly or annual basis. Payment is due upon subscription activation. We use third-party payment processors to handle transactions securely.

Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can manage your subscription and cancel at any time through your account settings.

Refund Policy

We offer a 14-day money-back guarantee for new subscriptions. After this period, subscription fees are generally non-refundable. Refund requests may be considered on a case-by-case basis.

Price Changes

We may change subscription prices at any time. Price changes will be communicated at least 30 days in advance and will take effect at the start of the next billing period.

Permitted Use

You may use SafetyHub Pro only for lawful purposes and in accordance with these Terms of Service. You agree to use the service for legitimate fleet management and compliance purposes.

Prohibited Activities

You may not: (a) use the service for any illegal purpose; (b) attempt to gain unauthorized access to our systems; (c) transmit viruses or malicious code; (d) interfere with other users' use of the service; (e) reverse engineer or attempt to extract our source code; (f) use automated systems to access the service without permission; (g) impersonate any person or entity.

Data Accuracy

You are responsible for the accuracy and completeness of all data you enter into SafetyHub Pro. We are not responsible for any consequences arising from inaccurate or incomplete data.

Our Intellectual Property

SafetyHub Pro and its original content, features, and functionality are owned by SafetyHub Pro and are protected by international copyright, trademark, patent, and other intellectual property laws.

License to Use

We grant you a limited, non-exclusive, non-transferable license to access and use SafetyHub Pro for your internal business purposes in accordance with these Terms of Service.

Your Content

You retain ownership of all data and content you upload to SafetyHub Pro. By uploading content, you grant us a license to use, store, and process that content to provide our services.

Feedback

Any feedback, suggestions, or ideas you provide regarding SafetyHub Pro may be used by us without any obligation to compensate you.

Service Disclaimer

SafetyHub Pro is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, secure, or error-free.

Compliance Disclaimer

While SafetyHub Pro is designed to help with DOT compliance, we do not guarantee regulatory compliance. You are solely responsible for ensuring your operations meet all applicable laws and regulations. Our tools and analytics are for informational purposes only.

Limitation of Liability

To the maximum extent permitted by law, SafetyHub Pro and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

Maximum Liability

Our total liability for any claims arising from your use of SafetyHub Pro shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Your Indemnification Obligations

You agree to defend, indemnify, and hold harmless SafetyHub Pro, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any content you submit to the service.

Termination by You

You may cancel your subscription and close your account at any time through your account settings. Upon cancellation, you will retain access until the end of your current billing period.

Termination by Us

We may suspend or terminate your access immediately, without prior notice, for conduct that we believe violates these Terms of Service, is harmful to other users, or is harmful to our business interests.

Effect of Termination

Upon termination, your right to use SafetyHub Pro will immediately cease. You may request an export of your data within 30 days of termination. After 30 days, your data may be permanently deleted.

Survival

Provisions regarding intellectual property, disclaimers, limitations of liability, indemnification, and governing law shall survive termination of these Terms.

Service Updates

We may modify, suspend, or discontinue any aspect of SafetyHub Pro at any time, including features, functionality, or content. We will provide reasonable notice of significant changes.

Feature Changes

Features included in your subscription plan may change over time. We will notify you of any material changes to features included in your plan.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or your use of SafetyHub Pro shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Chicago, Illinois.

Class Action Waiver

You agree to resolve any disputes on an individual basis and waive your right to participate in a class action lawsuit or class-wide arbitration.

Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and SafetyHub Pro regarding your use of our services.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
